Commission Order Issued Regarding Hurricanes Gustav and Ike

The Oklahoma Tax Commission has issued Commission Order 2008-09-18-02 which pertains to the granting of relief to taxpayers affected by Hurricanes Gustav and Ike in September 2008. This Order reflects the waiver policy adopted by the Commission in cases where penalty and interest may be assessed on those taxpayers directly affected by the storms. This includes penalty and interest for delinquent tax filings and payments and the penalty for underpayment of estimated tax.

In order to efficiently process returns, affected taxpayers are directed to add the following designations in the side margin of their returns in red ink “Hurricane Gustav” or “Hurricane Ike” and attach a brief statement of their circumstances to their late filed return. The Oklahoma Tax Commission will make every effort to process these returns separately and bypass the normal computer generated billing. In the event that a bill or notice is sent to an affected taxpayer, they should contact the Oklahoma Tax Commission and explain why they are entitled to relief.
